Principal's Profile - Mr Michael Williams, SC


Michael B Williams SC has practised as a Barrister principally in Sydney, Australia since 1979 and more recently as Senior Counsel and as an Accredited Mediator.

He has been Head of Chambers at William Deane Chambers in Phillip Street, Sydney for some 7 years and was appointed Senior Counsel in 2002. Since 1979 his principal practice base has been in Sydney but he retains a practice at the New Zealand Bar from Bankside Chambers in Auckland. He is also an Associate Member of London Chambers at 1 Crown Office Row, Middle Temple.

Prior to establishing his principal place of practice in Sydney he was a Foundation Member of Canterbury Chambers, under the leadership of Muir Chilwell QC (later the Honourable Justice Sir Muir Chilwell) and the late Sir David Beattie, Justice of the Supreme Court of New Zealand and later Governor General, together with His Honour Judge GV Hubble.

Following admission to the Supreme Court of New Zealand at age 21 he practised principally at the New Zealand Bar in criminal law in jury trial and appellate areas including the Privy Council, in commercial, personal injury, medical negligence, entertainment, building and construction, aviation, estate, matrimonial property and defamation litigation.

Since establishing practice in Australia his principal areas of practice have been personal injury and medical negligence but with experience in commercial litigation, family protection, estate litigation, criminal defence including corporate crime, defamation and matrimonial (property adjustment) law.

He is an Accredited Mediator on both NSW Supreme and District Court Panels having undergone Mediator training with LEADR in 2005 since which time he has been appointed as Mediator in personal and workplace injury litigation, property adjustment litigation and workplace relations issues whilst maintaining an active practice as Senior Counsel principally in clinical negligence and both Defendant and Plaintiff personal injuries litigation.

He has delivered a small number of Papers on topics including Mediation, Professional Negligence, Concurrent Expert Evidence, Bench and Bar Relations and Native Title (Commonwealth Law Conference London 2005).

In acting as a Mediator his aim is to assist in establishing a civilised, professional atmosphere amongst the parties in which they can be assisted in finding some intelligent common ground and a way through to a dignified and rational resolution. In acting as a Mediator, Michael brings his experience of acting as Senior Counsel for both Defendants and Plaintiffs in many mediations and his observation of a wide range of other Mediators’ techniques, skills (and foibles).

It is his objective to apply serious preparation on his part to achieve a proper understanding of not just the dispute/litigation itself but of the position of the parties and their aspirations in respect of their case. It is his further firm practice to extend courtesy and consideration to all parties and to ensure ongoing full involvement in the mediation as it proceeds whilst avoiding excessive intrusion or the imposition upon the parties of unsolicited personal evaluation.
